The former supermodel separated from Cook - her fourth husband - this summer after learning he had an affair with his teenage assistant.
Cook is "saddened by the fact that it's come to this," said Cook's attorney, David Aronson.
"He made it clear to anybody who would listen that he was very, very hopeful that he and Mrs. Brinkley would be able to work through this situation and get through it," Aronson added. "He was hoping they would be able to move forward with their marriage."
Brinkley publicist Elliot Mintz did not confirm nor deny the details of the summons to The Associated Press yesterday.
The assistant to Brinkley's lawyer, Eleanor Alter, declined comment.

Brinkley had been married to Frenchman Jean-Francois Allaux, singer Billy Joel, and developer Richard Taubman.
Aronson said it was too early to discuss how the couple would decide custody and assets, including a reported $60 million in real estate.
"He respects her decision, and has instructed us that this matter is to be handled in as amicable and private way as possible," Aronson said, adding that Cook's legal team would respond to the summons soon.
