In his complaint, Mr. Mazur alleges that after more than five years of employment, he was terminated from his position as a Senior Vice-President and Financial Advisor at Morgan Stanley as a result of the company’s decision to embark upon a reduction-in-force which, in purpose or effect, discriminated against older employees specifically targeting Financial Advisors who were over the age of 60. An August 11, 2005 Dow Jones News Wire article appears to support Mr. Mazur’s allegation indicating that under Morgan Stanley’s 2005 reduction-in-force, brokers over age 60 would be treated differently than younger brokers. Mr. Mazur brings this action against the defendants alleging a violation of the California Fair Employment and Housing Act and wrongful termination in violation of public policy.
Mr. Mazur’s complaint also alleges that Morgan Stanley is dogged by a long and sordid history of allegations that it routinely engages in illegal employment discrimination and other violations of the law. The complaint alleges that Morgan Stanley paid $54 million to settle a sex discrimination lawsuit, $1 million to settle a race discrimination lawsuit, and that Morgan Stanley was recently hit with a $1.578 billion judgment (including $850 million in punitive damages), in a case involving claims that Morgan Stanley provided false financial information to investors.
Andrew H. Friedman, Mr. Mazur’s counsel stated: “Mr. Mazur is a wonderful man. He alleges that Morgan Stanley discriminated against him on the basis of his age. We think he’ll be a terrific witness and we look forward to representing him in the trial in this matter.”
